Terms of Service

These Terms of Service ("Terms") govern your access to and use of abaone.org and the products offered by ABA ONE ("ABA ONE," "we," "us"), including AetherMAIL (the "Services"). By using the Services, you agree to these Terms. If you do not agree, do not use the Services.

The Services

ABA ONE provides software for outbound sales and marketing, including AetherMAIL, our email infrastructure platform. Features and availability may change as we improve the Services.

Accounts and eligibility

You must be at least 18 and able to form a binding contract to use the Services. You are responsible for the accuracy of your account information and for all activity under your account, including keeping your credentials secure.

Subscriptions, billing, and renewals

Paid plans are billed on a recurring monthly basis through our payment provider, Stripe. By subscribing, you authorize us (via Stripe) to charge your payment method the applicable plan fee each billing period until you cancel. Fees are stated in U.S. dollars and exclude any applicable taxes. Plans automatically renew each month unless cancelled before the renewal date.

Cancellation

You may cancel at any time; cancellation stops future renewals and takes effect at the end of your current billing period. See our Refund & Cancellation Policy for details.

Acceptable use

You agree not to use the Services to send unlawful, deceptive, or unsolicited bulk messages in violation of applicable law, to infringe others' rights, to distribute malware, or to attempt to disrupt or gain unauthorized access to the Services. When using AetherMAIL, you are responsible for complying with all applicable laws governing electronic communications, including anti-spam and data-protection laws (such as CAN-SPAM, CASL, and GDPR where they apply), and for honoring opt-out requests.

Your content and data

You retain ownership of the data and lists you bring to the Services. You grant us a limited license to process that data solely to provide the Services to you. You represent that you have the necessary rights and permissions for the contacts you upload and message.

Intellectual property

The Services, including software, branding, and content, are owned by ABA ONE and protected by law. We grant you a limited, non-exclusive, non-transferable right to use the Services per these Terms.

Disclaimers

The Services are provided "as is" and "as available" without warranties of any kind, express or implied, to the maximum extent permitted by law. We do not guarantee specific results, deliverability rates, or uninterrupted operation.

Limitation of liability

To the maximum extent permitted by law, ABA ONE will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues. Our total liability for any claim relating to the Services will not exceed the amount you paid us in the three months before the event giving rise to the claim.

Termination

We may suspend or terminate access if you violate these Terms or use the Services in a way that creates risk or legal exposure for us or others. You may stop using the Services at any time.

Governing law

These Terms are governed by the laws of the United States and the state in which ABA ONE is established, without regard to conflict-of-laws rules.

Changes

We may update these Terms. Material changes will be posted here with an updated date. Continued use after changes means you accept the updated Terms.
